Terms of Service

Please read these terms carefully before using DozHost services. Last updated: January 1, 2026.

1. Scope of Application

1.1 These Terms of Service ("ToS") of DozHost (hereinafter referred to as "Provider") apply to all contracts that a consumer or entrepreneur (hereinafter referred to as "Customer") concludes with the Provider with regard to the services presented on its website. DozHost operates as a reseller of hosting infrastructure and related services. The inclusion of the customer's own terms and conditions is hereby contradicted, unless otherwise agreed.

1.2 A consumer within the meaning of these ToS is any natural person who concludes a transaction for purposes that are predominantly neither commercial nor self-employed in nature.

1.3 An entrepreneur within the meaning of these ToS is a natural or legal person who, when concluding a transaction, acts in the exercise of their commercial or independent professional activity.

2. Services

2.1 The Provider offers services for hosting content and applications via the Internet. This includes virtual private servers (VPS), dedicated servers, cloud storage, and related services. The exact scope of each service can be found in the respective service description on our website.

2.2 The Provider's services for data transmission are limited solely to data communication within the Provider's network infrastructure. The Provider is not able to influence data traffic outside its own communication network and does not guarantee successful forwarding of information beyond its network.

2.3 The Provider's services are offered subject to availability. 100% availability is technically impossible and cannot be guaranteed. However, the Provider makes every effort to keep services available as consistently as possible. Maintenance, security or capacity requirements, as well as events beyond the Provider's control (disruptions to public communication networks, power outages, upstream provider issues, etc.) may lead to temporary service interruptions.

2.4 Unless otherwise agreed, the Provider does not make backup copies of customer content. The Customer is responsible for creating and maintaining sufficient backup copies of their data and for not storing it exclusively on the Provider's servers.

2.5 The Provider is entitled to adapt the hardware and software used to provide services to the current state of the art. If such an adjustment creates additional requirements for the Customer, the Provider shall notify the Customer in a timely manner.

3. Changes to Services

3.1 The Provider reserves the right to change the services offered or to offer different services, unless this is unreasonable for the Customer.

3.2 The Provider may change services without notice if:

  • Required due to a change in legal regulations
  • Necessary to close existing security gaps
  • The change is purely beneficial to the Customer
  • The change is of a purely technical or procedural nature with no significant impact on the Customer
  • Required due to changes by upstream infrastructure providers

4. Conclusion of Contract

4.1 The services described on the Provider's website do not constitute binding offers on the part of the Provider, but serve to invite the Customer to submit a binding offer.

4.2 The Customer may submit an order via the online order form or via our Discord server or support ticket system. By completing an order, the Customer submits a legally binding offer for the selected services.

4.3 The Provider may accept the Customer's offer by sending a written order confirmation via email or by requesting payment. The contract is concluded at the time of acceptance.

4.4 Order processing and contact typically take place via email, Discord, or our support ticket system. The Customer must ensure that all contact details provided are accurate and up to date.

5. Obligations of the Customer

5.1 Content stored by the Customer on their server may be protected by copyright and data protection law. The Customer grants the Provider the right to make stored content accessible via the Internet as necessary to provide the service.

5.2 The Customer undertakes not to store any content that violates applicable law or the rights of third parties. The Customer must also ensure that scripts or software installed by the Customer do not endanger the operation of the Provider's servers or network, or the security and integrity of other customers' data.

5.3 The Customer shall indemnify the Provider against all claims asserted by third parties due to infringement of their rights caused by content stored by the Customer. The Customer shall bear all costs of legal defense arising from such claims.

5.4 In the event of a breach or imminent breach of the above obligations, the Provider is entitled to temporarily suspend the Customer's service with immediate effect. The Provider shall notify the Customer of such action without delay.

5.5 The Customer is responsible for maintaining the security of their server, including regular password changes, applying security updates, and protecting access credentials.

6. Payment & Billing

6.1 All prices listed are in Euros (€) and are subject to change. The Provider will notify Customers of any pricing changes in advance.

6.2 The Provider currently accepts cryptocurrency payments only. All payments are processed manually via our Discord server or support ticket system. Services are activated only after payment is confirmed.

6.3 The Customer is responsible for ensuring timely payment to avoid service interruption or termination. Late or missing payments may result in service suspension without prior notice.

7. Refund Policy

All sales are final. DozHost does not offer refunds under any circumstances. Please carefully review your order and the service specifications before completing your purchase. By completing a purchase, you acknowledge and accept this no-refund policy.

8. Term and Termination

8.1 Services are provided on a recurring basis as per the billing period selected at the time of purchase. The Customer may cancel their service at any time by contacting support, however no refund will be issued for unused time.

8.2 The Provider reserves the right to terminate the Customer's service immediately and without notice if the Customer is found to be in violation of these Terms of Service or our Acceptable Use Policy. No refund will be issued upon termination due to policy violations.

8.3 Notices of termination by the Customer must be submitted via email or support ticket.

9. Liability

9.1 The Provider shall be liable without limitation in cases of intent or gross negligence, or in the event of intentional or negligent injury to life, limb, or health.

9.2 In cases of negligent violation of a material contractual obligation, liability shall be limited to foreseeable damages typical for the contract.

9.3 The Provider shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, revenue, or profits, arising from the use of our services or any upstream provider outages or issues.

10. Amendments to Terms

10.1 The Provider reserves the right to amend these Terms of Service at any time. The Provider will notify Customers of significant changes via email or Discord. Continued use of our services after such notification constitutes acceptance of the updated terms.

10.2 The Provider may also amend these terms without notice if required by changes in legal regulations, court orders, security requirements, or upstream provider policies.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the jurisdiction of courts in India.
